“You seem to consider the judges the ultimate arbiters of all constitutional questions; a very dangerous doctrine indeed, and one which would place us under the despotism of an oligarchy. Our judges are as honest as other men, and not more so… and their power [are] the more dangerous as they are in office for life, and are not responsible, as the other functionaries are, to the elective control. The Constitution has erected no such single tribunal…” (1)
“The biggest myth about judges” is that many uninformed Americans believe “they’re somehow imbued with greater insight, wisdom and vision than the rest of us…that God Almighty has endowed them with superior judgment about justice and fairness.” (2)
Thomas Jefferson, one of our premier founders, recognized their flaws as our government was being formed and gave numerous warnings on this. Who would know better than him?
I want to show you the character of some judges who served on the Supreme Court that confirms what Jefferson said long ago:
John Rutledge – Appointed by President Washington in 1795 “his mind was frequently so much deranged, as to be in a great measures deprived of his senses” after his wife died. His depression led him to attempt suicide twice. (3)
James C. McReynolds – Appointed by Woodrow Wilson in 1914 both were anti-semitic. McReynolds hated Jews and blacks and refused to stand next to Justice Lewis Brandeis (the first Jewish justice) for the official photo of the Court in 1924. As a result, no photo was taken. (4)
Hugo Black (photo to right) – Appointed by Franklin Delano Roosevelt (FDR) was a member of the Ku Klux (KKK). He suffered a stroke causing his mental faculties to decline rapidly, leading to paranoia. He feared President Richard Nixon was preparing to take over America by using military force. (5
William O. Douglas – Another FDR appointee allegedly assaulted a woman in his office. (6)
Thurgood Marshall (photo to left) – Appointed by Lyndon Baines Johnson (LBJ) and after a series of illnesses refused to step down because he didn’t want a conservative to replace him. He “became indifferent to his judicial duties…left much of the writing of his opinions to his clerks and sometimes didn’t bother to read the briefs submitted by counsel…he spent many hours watching television in his chambers, especially soap operas” He also trashed the Constitution and the Founders. Jefferson saw the danger of an activist court and made this statement hundreds of years ago, which has come to fruition in our times: “The germ of dissolution of our federal government is in the constitution of the federal judiciary; an irresponsible body, (for impeachment is scarcely a scare-crow,) working like gravity by night and by day, gaining a little to-day and a little to-morrow, and advancing its noiseless step like a thief, over the field of jurisdiction, until all shall be usurped from the States, and the government of all be consolidated into one.” (8)

Jefferson on judgment: “The God who gave us life gave us Liberty…And can the liberties of a nation be thought secure when we have removed their only firm basis, a conviction in the minds of the people that these liberties are of the gift of God? That they are not to be violated but with His wrath? Indeed I tremble for my country when I reflect that God is just; that His justice cannot sleep forever.”
Which brings me back to the Declaration. In one line the Founders told us why they went to war – “…the laws of nature and of nature’s God…” The motivation for going to war was because George III put himself above God and His laws. Keep in mind, at that time there were no governments in existence that gave consent to the governed. All nations had kings, some type of monarchy or else they were ruled by tyrants. (1)
Here’s the definition on the laws of nature from William Blackstone: “Man, considered as a creature, must necessarily be subject to the laws of His Creator, for he is entirely a dependent being…as man depends absolutely upon His Maker for everything, it is necessary that he should in all points conform to His Maker’s will. This will of his Maker is call the law of nature…dictated by God Himself, is of course superior in obligation to any other. It is binding over all the globe…at and no times; no human laws are of any validity, if contrary to this.
If these judges rule the wrong way on marriage, hang on! We need to heed the warning from Jude 7 because I believe God will move in, just as He did in the past. Then read 1 Chronicles 21, especially verse 16. You’ll see…
